Teachers and Jurists analyze regulations during the COVID 19 pandemic in Colombia

The virtual space led by the Permanent Chair Samuel Ernesto Constaín González, has allowed since April a space to reflect on regulations and the state of social andecological emergency.

Since April, the Samuel Ernesto Constaín González Permanent Chair has organized a series of virtual conferences called “COVID-19 Legal and Social Incidents in Colombia”. The conferences given by prominent teachers and jurists make a series of analyzes of the regulations in force during the COVID 19 pandemic in our country and are broadcast on Facebook Live and the YouTube channel.

 

Insolvency law, sports law and labor rights have been some of the topics addressed during the sessions of this chair that is held with teachers and students of the Faculty of Law, Political and Social Sciences of the University of Cauca.

 

We highlight some such as the analysis of the new insolvency regime or Decree 560 of 2020, where the legal and economic tools and mechanisms that the National Government has created to deal with the financial crisis were exposed. During the virtual discussion, the professor at the Santiago de Cali University, Edgar Humberto Campos Gómez, stated that "it is none other than the new emergency insolvency regime for people who begin to present a situation of financial crisis generated by COVID 19”.

 

"It is very important to bear in mind that the standard, Decree 560, is not only aimed at large, small and micro merchants, but is also directed at the non-merchant natural person," added the teacher.

Similarly, the cycle of conferences during its session on May 11 addressed the topic of sports law, where the main legal and legal aspects of sport were discussed and where students of the legal sciences were invited to see in this area of law a promising field for their professional practice.

 

"Sports law is very broad and also very specific when it comes to issues such as doping, transfers, reward mechanisms and specific use of the image rights of athletes," said Andrés Felipe Guapacha Orozco of the Colombian Sports Law Association.

 

The Samuel Ernesto Constaín González Permanent Chair also addressed the issue of labor rights in the current situation of the country and the world, the subject was analyzed by lawyers Harold Mosquera Rivas, Laura Isabel Castañeda and Wilson Eduardo Castañeda.

"We reflect on our reality at work, how this situation impacts companies and what possible solutions could be taken into account by the government entities that are managing the situation," emphasized Wilson Eduardo Castañeda of WECH Abogados S.A.S.

 

"We address issues of great legal and social relevance such as the protocols that organizations must assume to protect the health and life of their workers, as well as the powers, obligations and rights that employers have to preserve and protect employment," adds the lawyer Laura Isabel Castañeda.

 

"The world of work as we have known it will hardly be the same again; the pandemic that affects the world today has had very serious harmful effects on labor relations. Let us think first, about guarantees of life, of worker safety, to his health, his personal integrity and from there then we establish that it can be arranged with the Government and with the employers,”contributed Harold Mosquera Rivas, labor lawyer and teacher at the University of Cauca.

From this perspective, he points out that workers must be more organized than ever to creatively defend fundamental rights, concludes the lawyer in his dissertation on the regulations issued by the National Government in the framework of the current social and ecological state of emergency, and how Such decrees affect labor relations.
